Do I need a will if I already have assets in joint ownership?
Joint ownership does not cover all assets, and circumstances can change unexpectedly. A will ensures your wishes are clear for property, savings, and personal possessions that may not be jointly held. It also allows you to appoint guardians for minor children. We are happy to review your situation and advise without any pressure to proceed.
How long does the probate process typically take in Malaysia?
Timelines vary depending on the complexity of the estate and the court's schedule. A straightforward grant of probate may take between three and six months. More complex estates or contested matters will take longer. We provide an honest assessment at the outset and keep you informed as the matter progresses.
Can a will be updated after it has been signed?
Yes. A will can be amended by a codicil (a formal addition) or replaced entirely with a new will. Life changes — marriages, the arrival of children, changes in assets — are good reasons to review your will. We offer a dedicated will review service for those who already have a document in place.
What happens if someone passes away without a will in Malaysia?
The estate is distributed according to the Distribution Act 1958 for non-Muslims, or faraah principles under Islamic law for Muslims. These statutory rules may not reflect the deceased's personal wishes and can occasionally lead to outcomes the family did not expect. We assist families in these situations to obtain letters of administration and settle the estate as smoothly as possible.
What is a trust, and do I need one?
A trust is a legal arrangement where assets are held by one party for the benefit of another. Whether a trust is appropriate depends on your circumstances — we take time to understand your situation before making any recommendation.
Are your fees fixed or do they vary?
We provide clear fee information at the start of each engagement. Will drafting begins from RM 200, estate planning advice from RM 420, and probate administration from RM 630. More complex matters are discussed and agreed upon openly before any work begins. There are no charges for an initial enquiry.
